OFFER AGREEMENT FOR ORDER, PURCHASE, SALE AND DELIVERY OF GOODS 

This contract between FOP Rohanova Anna Ihorivna (EDRPOU: 3658000785), hereinafter "Seller" and the user of the services of the moldavecamour.com website, hereinafter - "Customer, Buyer", is an assignment contract for the order, purchase and delivery of Goods and defines the main terms of the order , purchase and delivery of goods through the Internet site moldavecamour.com. The buyer, acting for the purpose of purchasing the Goods, accepts the terms of this contract of sale of goods (hereinafter referred to as the Contract) on the following terms. 

1. DEFINITION OF TERMS 

1.1. Public offer (hereinafter referred to as the "Offer") is a public offer of the Seller, addressed to an unspecified number of persons, to enter into a contract for the sale of goods remotely with the Seller (hereinafter referred to as the "Agreement") on the terms and conditions contained in this Offer, including all Appendices. 

1.2. Order - the Customer's decision to order goods and their delivery, made through the website moldavecamour.com and/or an order for the purchase and delivery of goods. 

2. GENERAL PROVISIONS 

2.1. The following information is an official proposal (offer) of the moldavecamour.com website to any natural person (hereinafter referred to as the Buyer) to enter into a contract for the sale of goods. This contract is public, that is, according to Article 633 of the Civil Code of Ukraine, its conditions are the same for all buyers. 

2.2. According to Article 642 of the Civil Code of Ukraine, full and unconditional acceptance of the terms of this offer (offer), which confirms the conclusion of the Agreement for the purchase and sale of goods on the terms proposed below, is the fact of registration and confirmation of the order. 

2.3. By completing the Order, the Buyer confirms agreement and unconditional acceptance of the terms of this proposal (offer). 

2.4. By concluding the Agreement (that is, by accepting the terms of the real Offer (Offered Opportunities) by placing the Order, the Buyer confirms the following: 

a) The buyer is fully and completely acquainted with and agrees with the terms of this offer; 

b) The buyer gives permission for the collection, processing and transfer of personal data under the conditions specified below in the Clause on the collection, processing and transfer of personal data. The permission to process personal data is valid for the entire term of the Agreement, as well as for an unlimited period after its expiration. 

In addition, by concluding the Agreement, the Customer confirms that he has been notified (without additional notification) of the rights established by the Law of Ukraine "On the Protection of Personal Data", the purposes of data collection, as well as the fact that his personal data is transferred to the Seller for the purpose of being able to fulfill the conditions of this Agreement, the possibility of mutual settlements, as well as for receiving invoices, acts and other documents. The Customer also agrees that the Seller has the right to provide access and transfer his personal data to third parties without any additional notifications from the Customer, without changing the purpose of personal data processing. The extent of the Customer's rights as a subject of personal data in accordance with the Law of Ukraine "On the Protection of Personal Data" is known and understood by him. 

3. PRICE OF THE GOODS 

3.1. The price for each item of the Product is indicated on the Internet site moldavecamour.com 

3.2. The Seller has the right to unilaterally change the price for any item of the Goods. 

3.3. In the event of a price change for the ordered Product, the Seller undertakes to inform the Buyer about the change in the price of the Goods. 

3.4. The Buyer has the right to confirm or cancel the Order for the purchase of the Goods, if the price has been changed by the Seller after placing the Order. 

3.5. The Seller cannot change the price of the Goods paid by the Buyer. 

3.6. The price and terms of delivery of the Goods are set by the relevant logistics company. 

The seller can indicate the approximate cost of delivery of the Goods on the Internet site moldavecamour.com r inform the Buyer when placing the order by the Operator, but the final cost of delivery is determined by the logistics company independently, depending on the delivery conditions and tariffs. 

3.7. The Buyer's obligations to pay for the Goods are considered fulfilled from the moment the funds are received by the Seller. 

3.8. Settlements between the Seller and the Buyer for the Goods are made by the methods indicated on the Internet site moldavecamour.com in the section "SHIPPING AND PAYMENT". 

4. PROCESSING THE ORDER 

4.1. The Order of the Product is carried out by the Buyer through the service of the Internet site moldavecamour.com 

4.2. When registering on the Internet site moldavecamour.com the Buyer undertakes to provide the following registration information: 

4.2.1. surname, first name, patronymic of the Buyer or the person indicated by him (recipient); 

4.2.2. address to which the Goods should be delivered (if delivery to the Buyer's address) or the address of the delivery point of the logistics company; 

4.2.3. contact phone; 

4.3. name, quantity, article number, price, total cost of the Goods selected by the Buyer are indicated in the Buyer's order on the Internet site moldavecamour.com 

4.4. If the Seller needs additional information, he has the right to request it from the Buyer. If the Buyer does not provide the necessary information, the Seller is not responsible for the quality of services provided to the Buyer when purchasing goods through the Internet site moldavecamour.com 

4.5. When placing an Order through the Operator (clause 4.1. of this Offer), the Buyer undertakes to provide the information specified in clause 4.2. of this Offer. 

4.6. Approval by the Buyer of the terms of this Offer is carried out by entering the relevant data into the registration form on the Internet site moldavecamour.com when placing the Order through the Operator. After placing the Order through the Operator, data about the Buyer are registered in the Seller's database. 

4.7. The Buyer is responsible for the reliability and accuracy of the information provided when placing the Order. 

4.8. The remote sales contract between the Seller and the Buyer is considered concluded from the moment the order is placed electronically on the website service moldavecamour.com, or the Buyer receives the corresponding receipt from the payment system/bank, or another document confirming payment for the Goods. 

4.9 The Seller has the right to take an advance payment for an order for an individual product, made to size and/or in his own design, in the amount of 50% of the cost of the product. In case of rejection of such goods by the Buyer and the goods have not yet been delivered to the Buyer, the Seller does not return the advance payment. It is possible to refuse the goods under the order within a day from the moment of receiving the advance payment. If the ordered goods are delivered and paid for by the Buyer in good condition, the Seller does not refuse the goods and/or refund the money. 

5. DELIVERY AND HANDOVER OF GOODS TO THE BUYER 

5.1. The methods of delivery and payment of goods are indicated on the website moldavecamour.com in the section "SHIPPING AND PAYMENT". The order and terms of delivery and payment of the ordered goods are agreed by the Buyer with the operator of the Internet site when placing the order. 

5.2. The right of ownership and the risk of accidental loss or damage to the goods are transferred to the Customer or his Representative from the moment of receipt of the goods by the Customer signing the goods receipt and / or order upon delivery / receipt of the Goods. 

5.3. The delivery of goods is organized by the Seller's own forces in accordance with the terms of delivery, or with the involvement of third parties (delivery by a logistics company). 

The Seller independently determines the logistics company or the list of logistics companies with which he cooperates on the delivery of the Goods. 

5.4. When receiving the goods, the Customer must check the conformity of the Goods with the qualitative and quantitative characteristics (product name, quantity, completeness, expiration date) in the presence of the Seller's representative - the courier (during courier / address delivery) or the representative of the logistics company. 

5.5. The Customer or the Customer's representative, upon receiving the goods, confirms with his signature on the goods receipt and/or the order for the delivery of the goods that he has no complaints about the quantity of the goods, appearance and completeness of the goods. 

6. RETURN OF GOODS 

6.1. The exchange and return of the Goods is carried out in accordance with the requirements defined by the Law of Ukraine "On the Protection of Consumer Rights", Resolution of the Cabinet of Ministers of Ukraine dated March 19, 1994 No. 172 "On the Implementation of Certain Provisions of the Law of Ukraine "On the Protection of Consumer Rights". 

6.2. The Customer has the right to refuse the goods at any time before their transfer, and after the transfer of the goods - in the manner and under the conditions specified by the Law of Ukraine "On the Protection of Consumer Rights". 

The return of Goods is carried out taking into account the restrictions and the list of goods of proper quality that are not subject to exchange-return, established by Appendix No. 3 of the Decree of the Cabinet of Ministers of Ukraine dated March 19, 1994 N 172 On the implementation of certain provisions of the Law of Ukraine "On the Protection of Consumer Rights. 

6.3. The return of goods of proper quality is possible if its appearance, consumer properties, as well as a document confirming the fact of payment and the terms of ordering the specified product are preserved. 

6.4. The Customer does not have the right to refuse a good quality product that has individually defined properties, if the specified product can be used exclusively by the consumer who purchased it, and / or was made to individual order (including non-standard ones, at the request of the customer) , dimensions, etc.). The confirmation that the product has individually defined properties is the difference in product sizes and other characteristics indicated on the Internet site moldavecamour.com. 

6.5. The return of goods, in the cases provided for by law and this Agreement, is carried out at the address specified in this Agreement and at the contacts on the Internet site moldavecamour.com in the section "CONTACTS". 

6.6. In the event of the Buyer's rejection of the goods of the appropriate quality, the Seller will refund the amount of the cost of such Goods, with the exception of the Seller's costs for delivery - the return of the returned goods. Refunds for such goods are made by the Seller within 10 days from the moment of receipt of the returned goods. 

6.7 Individual goods made to order delivered and paid for by the Buyer in proper condition, the Seller does not refuse the goods and / or refund the money. 

7. RESPONSIBILITY OF THE PARTIES 

7.1. The Seller is not responsible for damage caused to the Buyer as a result of improper use of Goods pre-ordered through the Internet site moldavecamour.com and purchased from the Seller. 

7.2. The Seller is not responsible for improper, untimely fulfillment of Orders and its obligations in case the Buyer provides unreliable, incomplete or erroneous information. 

7.3. The Seller and the Buyer are responsible for fulfilling their obligations in accordance with the current legislation of Ukraine and the provisions of this Agreement. 

7.4. The Seller or the Buyer is released from responsibility for full or partial non-fulfillment of their obligations, if the non-fulfillment is the result of force majeure circumstances such as: war or hostilities, earthquake, flood, fire and other natural disasters, quarantine restrictions, decisions of state authorities that arose regardless of the will of the Seller and / or the Buyer after the conclusion of this contract. A Party that cannot fulfill its obligations shall immediately notify the other Party thereof.
